Howard K. Stern and doctors  Khristine Eroshevich, Sandeep Kapoor will be going to trial for a long list of felonies relating to the death of Anna Nicole Smith. The doctors are accused of supplying Stern with the drugs he needed to keep Anna Nicole in the haze that she was in up until the time that she eventually overdosed.

Stern alone is responsible for over 11 felony accounts, including giving prescription drugs to an addict, acquiring those drugs illegally and fraud. Kapoor is also screwed. During the previous investigation, the following passage was found in his journal, “I was making out with Anna, my patient, blurring the lines … I gave her methadone, Valium. Can she ruin me?”

The death of Anna Nicole has always stood out to me as incredibly sad because it was clear that in her messed up state, Anna had been allowing a lot of people to take advantage of her for a long time. Stern, who many saw on Anna Nicole’s E! reality show had been with her for a long time and even when she was top dog in the relationship, he often seemed both manipulative and emotionally abusive toward her. Their relationship was never appropriate, and when he saw that he could possibly gain control of her estate if she was dead, well, it wouldn’t surprise me if he turns up to be guilty on most of those charges.

And the saga continues!

Anna Nicole Smith’s longtime partner and attorney Howard K. Stern and two doctors were charged Thursday with conspiring to furnish drugs before her death in 2007, according to the Los Angeles County District Attorney’s Office. …

At the time of her death several prescription medications — both in Smith’s name and that of her partner and lawyer, Stern — were found in the room.

Officials said prescription and over-the-counter drugs were found in Smith’s system, including three antidepressants or antianxiety drugs. Also found in toxicology testing was human growth hormone and chloral hydrate, a sleep medication, officials said.

Stern, 40, and doctors Sandeep Kapoor, 40, and Khristine Eroshevich, 61, were each charged with eight felonies, including conspiring to furnish controlled substances, unlawfully prescribing a controlled substance and obtaining fraudulent prescriptions between June 2004 and January 2007 — only weeks before the playmate’s death.

Kapoor and Eroshevich were each also charged with obtaining a prescription for opiates by “fraud, deceit or misrepresentation.” Each were also charged with one count of obtaining a prescription for opiates by giving a false name or address, according to the DA’s office.

All three were charged with one count of “prescribing, administering or dispensing a controlled substance to an addict.”

Hells yeah! It’s about time these people are held responsible. Anna Nicole was making horrible, fatal choices, but these people, particularly the doctors, were breaking the law in order to enable her. I certainly hope they make an example of this. It’s the same situation with Heath Ledger — who the hell was prescribing him all these narcotics, one on top of another? It happens day after day in this country, doctors over-prescribing narcotics for people who they must have figured out are addicts. Especially rich and famous people.

As Gawker points out, though, this might be about more than just doing the right thing. The California Attorney General, Jerry Brown, is pressing the case … and he’s also planning to run for governor. Sigh. Whatever it takes, guys.

Howard and Dr. Sandeep Kapoor were released Thursday night after each posted $20,000 bond.

So I haven’t really been following this story on here, because the story’s retarded, but basically there’s some new book coming out alleging that Howard K. Stern was all gay with Larry Birkhead, and they videotaped themselves doing the nasty and Anna Nicole liked to watch it. HKS is, of course, denying it, because it is, as I mentioned, retarded.

“It’s ridiculous. I mean it’s absolutely absurd,” Stern said to ETOnline. “Dannielynn is gonna read this garbage and it’s almost like she’s gonna have to get counseling from the age of 3.”

Um, look. I’m as hopeful as the next guy about Dannielynn’s future, but, buddy, if you think this girl’s gonna be able to read at the age of 3, I have a bridge I wanna sell you.

After spending almost two hours in a Bahamian courtroom sans cameras, Larry Birkhead emerged victorious on Tuesday afternoon, as a doctor told the judge that the DNA tests revealed that he was the father of Anna Nicole’s baby, Dannielynn, with “99.9999% certainty.”

When asked about the paternity results, Howard K. Stern, who is currently listed on the birth certificate as Dannielynn’s father, stayed true to his word. “I am obviously very disappointed … I am not going to fight Larry Birkhead for custody. I will do everything I can to make sure he gets sole custody.” Stern and Birkhead hugged after leaving the courtroom, and Stern invited Birkhead to his house, where Dannielynn currently resides, to spend as much time with the baby as he wants.

The only reason Birkhead would not get custody at this point is Anna’s mother, Virgie Arthur, who had no role in this child’s life before Anna’s death, because Anna hated her. I don’t know much about family law, but I have no idea how this kid could possibly go to Arthur when there’s a healthy adult parent who wants her. Arthur’s custody case is expected to be heard on Friday in the same Bahamian court.

Man this judge is a jackass. What a blow-hard.

A bunch of stuff was denied. I don’t understand the legalese.

Jesus, this judge looks like he’s trying not to cry. What a tool. What the fuck is going on here? Holy shit the judge is crying.

They awarded the remains to the lawyer representing Dannielynn. He asks that this lawyer consult with all involved parties in making a decision.

Howard Stern’s head is on the table. Virgie Arthur is crying.

“I want her buried,” says the judge, “with her son. In the Bahamas. I want them to be together.” But he’s leaving that decision up to Dannielynn’s lawyer, who I assume will agree to have her buried in the Bahamas.

Howard K. Stern is sobbing audibly. His freakin’ lawyer is crying. Everybody is crying. Except Larry Birkhead. He’s not crying.

“And I hope to God,” says the judge, “You guys give the kid the right shot.” He’s still crying. This is the strangest damn thing I have ever seen.

The lawyers ask for a bunch of stuff I don’t understand, then ask for use of the chambers for the rest of the afternoon. The judge says sure in the most long-winded, blow-hardy way. They want the courtroom sealed for their discussions. No cameras. Judge says sure.

Court adjourned.

The Florida court proceedings to determine what will happen with Anna Nicole’s body began this morning. Before I begin with a recap, let me quickly explain to you (to the best of my understanding) what is going on here. There are two legal cases in progress regarding Anna Nicole. The first, in Los Angeles, California, is the paternity suit, where Larry Birkhead is pushing for DNA testing to determine who is the father of Anna’s baby daughter Dannielynn. Howard K. Stern opposes the testing. The second, in Ft. Lauderdale, Florida, exists to determine who gets custody of Anna Nicole’s body. Most of the media attention today focused on the Ft. Lauderdale case, where the parties concerned were present.

Howard K. Stern, Larry Birkhead, and Anna’s mother Virgie Arthur entered the courtroom around 9:30 a.m. Anna’s father, Don Hogan, was also present. The judge in the Ft. Lauderdale case is Larry Seidlin, a former NYC cabbie with a thick New York accent to prove it, who has reportedly hoped to have a Judge Judy-style television show of his own. He seems to have no problem whatsoever making a media circus of these proceedings. In fact, he appears to be encouraging it. He’s quite a character, this judge. He’s the anti-Ito.

Howard Stern wants Smith buried in the Bahamas, with her son, and his legal team argues that, as co-executor of Anna’s will, he should decide what happens to her remains. Anna’s mother’s team argues that Stern is not a blood relative and should not have a say in this issue. Anna’s will does not express her wishes on this matter.

Early in today’s proceedings, it was determined that Judge Seidlin would take jurisdiction of the paternity case which is currently pending in Los Angeles, and a lawyer was appointed to represent five-month-old Dannielynn in this case.

Stern’s lawyer, Krista Barth, kicked things off by complaining to the judge that Larry Birkhead’s lawyer, Deb Opri, accused him of “killing” Anna Nicole Smith during court proceedings this morning. Video here.

Howard Stern took the stand to discuss his relationship with Anna Nicole, noting that they were friends, and then lovers (”This was years ago,” he says. “We didn’t say anything at the time.”). He talks about how Anna never really recovered emotionally from the death of her son, and how she wanted to make sure that Daniel’s coffin was secure, because “both she and Daniel were afraid of bugs.” Video here.

In perhaps the strangest development so far, Stern’s testimony was interrupted by a phone call from the Broward County Medical Examiner, who stated that Anna Nicole’s body was deteriorating faster than normal. As such, DNA testing will have to be performed this week, instead of in two weeks as was planned. Stern sobbed audibly on the stand when he heard the news.

As the day wrapped up, the judge asked Howard K. Stern to appear in court again tomorrow. He was originally only supposed to appear today. The judge himself arranged for a private jet to take Stern on the short flight to the Bahamas tonight, and return him in the morning.

No news day would be complete without an update on the Anna Nicole saga. To summarize today’s findings:

The 911 call from the day of Anna’s death has been, um, either released or .. acquired. Listen to all the non-excitement of it here.

Anna Nicole’s former bodyguard, Alex Denk, has thrown his hat into the Dannielynn-paternity ring, bringing the number of potential daddies to five.

Anna Nicole’s mother has hired a lawyer to help in her quest to have Anna’s body released to her for burial.

Anna did have a will, written in 2001, naming Howard Stern as first executor.

And where there’s crazy, there’s the Barbi Twins, claiming they tried to get Anna to attend AA meetings with them several years ago, but she never called back.

Anna Nicole’s death consumed 50% of the cable newshole on February 8 and 9, much to the chagrin of CNN’s Jack Tafferty, who handled the situation with the sort of tact we normally reserve for vloggers and Shepard Smith.

Sigh. I’m so tired already tonight.

Oh and Howard K. Stern’s been found. Apparently he hopped a flight to the Bahamas with Entertainment Tonight’s Mark Steines, who scored the exclusive interviews with HKS after Anna’s death. ET will start airing the footage Monday night, but you can get a sense of the mood from Mark’s blog:

Howard, in tears, at times unable to speak, shares with me that Dannielynn is the light helping him go on. As the plane lifts above the clouds, Howard thinks of those his precious Anna Nicole left behind. In a voice barely heard above the din of the jet engines he tells me, “I want her friends to pray that Anna Nicole is safe, happy and with Daniel.”

They are also reporting that the Nurse of Anna Nicole found her not breathing but called the lawyer-dad Howard K. first and waited “a while” before calling 911. I would guess that’s because when she went to nursing school they told her helping that the patient came right after paying allegiance to the dark side.

Something tells me this will be getting worse and worse. That something is my brain.
