California Supreme Court Hears Final Arguments to Overturn Prop 8

March 5th, 2009 by Evil Beet

This morning, lawyers on both sides of the fence finished up their oral arguments for the California Supreme Court, where a group of citizens is challenging Proposition 8’s Constitutionality. We’ll know within 90 days how they decide.

After three hours of arguments, it seemed as though the seven justices leaned against voiding the 18,000 same-sex marriages performed last year, but their stance on Proposition 8’s constitutionality was less clear.

They’re grappling with issues such as what “inalienable” means when used to describe a constitutional right; whether such rights can be limited or revoked by an amendment, by a revision or at all; and how majority rule balances with protection of historically disadvantaged minorities’ fundamental liberties. The court will rule within 90 days.

Big issues, but a simple decision: ALL citizens should have EQUAL RIGHTS. There’s no question here.

I hope these justices get their heads on straight and overturn this hateful bullshit.

I watched the whole thing. Suffice to say Kenneth Star is a huge tool and needs more ways to fill out his day.

  3. JorgeMacD says:

I hope the next project is giving felons the right to vote

  4. just visiting says:

I agree, Beet. And, I pray that they don’t void the 18,000 marriages because ours would be one of those 18,000. We eloped to San Francisco on July 21. It was the happiest day of my life. There were people sitting in the main hall applauding as newly married couples walked past.

But, no matter what they do decide, they can’t take away the memories of that day.

congrats!!! I am a straighty, but am all about gay rights. I had such an amazing experience at anti-prop 8 rallies.

I am rooting for you guys!

  5. Redi says:

Yes, please keep us posted. I hope that it’ll be realized that we’re people too. We deserve the same rights as everyone else, regardless of who we love. It really hurts me to think people don’t agree to such.

Petition to: Ken Starr, Lead Counsel defending Proposition 8 before the CA Supreme Court

    Lies helped pass Prop. 8.
TODAY, Ken Starr is using them to defend it in court.
Tell Ken Starr that divorcing parents to protect children is absurd and malicious.

please go here and add your name
beet, please post this if you can

  7. yes on 8 says:

      I hear ya.
I was under the impression that after a vote, the outcome stands, regardless of whether people are pleased or displeased with it. I

ts been voted on; let it lie.

“I was under the impression that after a vote, the outcome stands, regardless of whether people are pleased or displeased with it.”

That’s historically untrue. If it were true, we’d still be allowed to keep slaves.

      • Becci says:

Um yeah, laws totally never change.

I assume you’re a woman, in which case it would have been illegal for you to vote in the first place if someone hadn’t CHANGED THE LAW 90 years ago.

        Idiot.

you should take a political science class or something, anonymous. Then you wouldn’t have to rely on false impressions.

      • Dinsoaurs says:

Actually, the California Supreme Court overturned a voter approved measure in 1966 that would have permitted racial discrimination in housing. The voters in California voted for this meausre by almost a 2 to 1 margin. They declared it was unconstitutional.

    • Anonymous says:

yeah, um, you’re an asshole. wait, is that why your so afraid of gay marriage?

  8. just me says:

to yes on 8- soon it will be legal in all states so it won’t matter where YOU MOVE! Everyone should have the right to marry any one they choose. Who thinks they have the right to deny them this? I have signed the petition and forwarded it to all my friends. I am a straight woman but have been married and if you are in love and want to marry NO ONE group should be allowed to say you cant.

    • Anon says:

I want to marry my sister. oh wait, I would like to marry my dog. oh, Actually, me and four other friends would like to be legally married all together and have equal rights. I mean, once it’s legal for same sexes to be married, then basically anyone else can claim equal rights. including other relationships listed above. I mean, right.

      • copa says:

congratulations, you just likened people of a different sexually then you to beasts, you must be proud. Or are you more the type to be happy to swear that being gay is harmful to children as it will turn them gay just like incest doubles the chance of genetic deformities in children.

Also I have no problem with poly relationships I say go for it.

  9. mcbiscuit says:

State by state is not the way to go. They tried that with universal suffrage and it resulted in women not being given the vote till 1922 (shameful).
Federal action to eliminate discrimination is needed.

  10. yup says:

marriage is between a man and a woman. The *real* haters are the people attacking supporters of this natural law. Scary.

    • Anonymous says:

^ if don’t like gay marriage, don’t get gay married. just because no one will ever marry u doesn’t mean u have to b such spiteful twat.

    • Anonymous says:

there is nothing natural about marriage. It’s a choice. Just because I am a straight woman doesn’t mean that naturally I plan on getting married. Marriage is a choice.

    • angry dyke says:

“the *real* haters are the people attacking supporters of this natural law. scary”
      are you fucking kidding me?
oh wait, yr not. apparently you are serious. How is giving gay people the right to marry threatening your precious straight union ? Really? I would like to know. Please enlighten me.

  11. BG says:

I’m all for anyone who loves each other being able to get married. I don’t really see what the big deal is. But at the same time, this country is a democracy. The people voted, and agree or not, that is how they voted. I don’t want the votes to stop counting and government making all of the decisions for us. If it is an issue of unconstitutionality then the Supreme Court should assess it and make any correction that is necessary. No matter what the personal beliefs, EVERYONE should be adamant that their VOTES MATTER.

  12. 3 Foot Lizard says:

Gat marriage isn’t a “right.” Stop pretending it is. With that said, I don’t care who marries who.

  13. Keith says:

I support prop 8 and that’s my rightful opinion. I don’t understand why it’s perfectly okay for people to bash people that support it but not the other way around. I have the freedom to have my own opinion, just as anyone else does. It’s tasteless and just plain rude to call someone a “stupid twat” or worse for thinking differently than you do.

    • copa says:

And how many rights do you expect taken from you just because someone has an opinion about them?

I suddenly don’t like that your male, I just cut your pay in half.

I don’t like the way your gravatar looks, you can no longer marry, have children, get your spouses assests for free when she dies, instead say goodbye to half for taxes.

You don’t have perfect vision you say? well you can no longer drive, or vote cause hey you might misread the ballot and not vote for someone I support with all your differences.
